User Agreement
This Agreement for the use of BAGT spaces is made between:
BAGT aka: Barbican Arts Group Trust and all participating Artists
BAGT spaces are defined as:
ArtWorks Project Space, HR Project Space, Atrium Space, Studios Space(s)
Types of use are referred to as “exhibition”.
1. Details of use
* Title of Exhibition / Event: __________________________
2. Responsibilities of BAGT
BAGT agrees to:
* Provide the exhibition space for the agreed dates.
* Promote the exhibition at its sole discretion.
* Allow the Artist access to the venue for installation and deinstallation at times scheduled by the BAGT.
* BAGT has no obligation to provide additional staffing, technical support, or marketing beyond what it determines reasonable.
3. Responsibilities of the Artist
The Artist shall:
* Deliver all artworks in a condition ready for display.
* Cover all costs of transportation, packing, framing, installation, and deinstallation.
* Cover cost of electricity consumed (metered on usage).
* Provide installation staff if required, unless otherwise agreed.
* Supply BAGT with promotional material (images, text, biography) in the requested format and by the deadline set by BAGT.
* Remove all artworks and materials immediately following the exhibition by the date specified. Any works not collected may be disposed of or stored at the Artist’s expense.
* Make good the space(s) after use.
4. Insurance and Liability
* The Artist is fully responsible for insuring artwork during transport, installation, exhibition, and deinstallation.
* BAGT assumes no liability for loss, theft, or damage of artwork under any circumstances, including negligence.
* The Artist indemnifies and holds harmless BAGT against any claims, damages, or expenses arising from the exhibition, including third-party claims.
5. Sales and Commission
* All sales of artwork must be conducted exclusively through the BAGT during the exhibition period.
* BAGT will retain a commission of 20% on all sales.
* BAGT will determine pricing in consultation with the Artist but reserves final approval.
* Payments to the Artist will be made within 28 days of BAGT receiving full cleared funds from the buyer.
* BAGT may extend discounts to buyers of up to 10% without reducing its commission.
6. Reproduction Rights
* The Artist grants BAGT a royalty-free, perpetual, non-exclusive license to reproduce, publish, and distribute images of the artworks for promotional, educational, and archival purposes, including online.
* BAGT may authorise press and media partners to reproduce images without additional approval.
7. Termination
* BAGT may cancel or reschedule the exhibition at any time and for any reason without liability other than returning unsold works.
* The Artist may not withdraw without written consent from the Gallery.
8. Governing Law
This Agreement shall be governed by and construed under the laws of the United Kingdom.
